The 1988 Federal Constitution establishes that the two fundamental principles of the economic order are: free enterprise and the appreciation of human labor and that all economic activities in the country must be aligned with these two topics. This article seeks to promote an analysis of the performance of the Brazilian State in the economic sphere, notably on the legal mechanisms that can be used to legalize this activity and the repression measures provided by law, as well as an analysis of the anticompetitive conduct of the year 2017 of CADE's balance sheet. Therefore, the present work seeks to analyze the State in its performance as a risk reducer for individuals and companies and as a guarantor of the security of a society that, many times, prioritizes the accumulation of capital to detriment of its own constitutional values and bring data how this economic protection mechanism works in Brazilian society in accordance with established policies.
